This privacy policy explains how we collect, use and look after your personal data when you use our website, ask us for a quote, or work with us to compare and switch your business utilities. We are committed to protecting your privacy and handling your data in line with UK GDPR and the Data Protection Act 2018.

What data we collect

Depending on how you contact us and what services you ask us to compare, we may collect:

  • Contact details: your name, business name, email address, phone number and business address.
  • Business utility bill data: the information shown on the bills you send us, including your current supplier, contract end date, tariff and rates.
  • Supply identifiers: your MPAN (electricity), MPRN (gas), water supply point ID (SPID), and similar identifiers for broadband, card processing and mobile services.
  • Usage data: how much energy, water, data or card transaction volume your business uses, so we can compare the market accurately.
  • Website data: information collected through cookies and analytics when you browse our site. See our cookie policy for detail.

Our lawful bases for using your data

Under UK GDPR we must have a lawful basis to process your personal data. We rely on:

  • Consent: when you send us your details and bills and ask us to compare the market on your behalf, and when you agree to non-essential cookies.
  • Legitimate interest: to respond to your enquiry, run our broking service, keep records of the quotes and switches we arrange, and protect our business. We only rely on this where it does not override your rights and interests.
  • Contract: where we need to process your data to provide the service you have asked us to deliver, including arranging a switch with a supplier.

How we use your data

We use your data to:

  • Compare the whole market on your behalf and find sharper deals on your business utilities.
  • Obtain quotes from suppliers and, where you confirm a switch, arrange that switch with the chosen supplier.
  • Contact your current and prospective suppliers on your behalf, where you have given us a Letter of Authority to do so. See our Letter of Authority page for what that allows.
  • Respond to your enquiries and keep you updated on your quote or switch.
  • Keep proper records and diary your contract renewal dates so we can re-quote before your contract ends.

Who we share your data with

We are a whole-of-market broker, so to do our job we share relevant data with third parties. We never sell your data. We may share it with:

  • Suppliers we quote on your behalf: energy, water, broadband, merchant services (card processing) and business mobile suppliers, so they can provide a quote and, where you confirm, set up your new contract.
  • Our CRM and back-office systems: we use a customer relationship management system to manage your enquiry, quotes and renewals securely.
  • Service providers: trusted partners who help us run our business, such as email and analytics providers, who act on our instructions.

Where any of these involve transfers outside the UK, we make sure appropriate safeguards are in place as required by UK GDPR.

How long we keep your data

We keep your personal data only for as long as we need it for the purposes set out above, and to meet our legal, accounting and regulatory obligations. Renewal and contract records are kept for the life of your relationship with us plus a reasonable period afterwards, so we can support you at your next renewal and meet record-keeping requirements. When we no longer need your data, we securely delete or anonymise it.

Your rights under UK GDPR

You have the following rights over your personal data:

  • Right of access: ask for a copy of the data we hold about you.
  • Right to rectification: ask us to correct data that is wrong or incomplete.
  • Right to erasure: ask us to delete your data, where there is no good reason for us to keep it.
  • Right to restriction: ask us to limit how we use your data.
  • Right to data portability: ask us to provide your data in a portable format.
  • Right to object: object to us processing your data, including where we rely on legitimate interest.

To exercise any of these rights, email us at hello@smarta.today. We will respond within one month.

How to complain

If you are unhappy with how we have handled your data, please contact us first so we can put it right. You also have the right to complain to the Information Commissioner's Office (ICO), the UK regulator for data protection. You can reach the ICO at ico.org.uk or on 0303 123 1113.
